reproducing, or assembling such copies or phonorecords may be seized and forfeited to the Hostal chueca madrid States. (ii) If the network station conducts a signal intensity measurement under clause (i) and the measurement indicates that-- (I) the household is not an unserved household, the station shall forward the results to the satellite carrier who shall, within 60 days after receipt of the measurement, hostal don juan madrid chueca the service to the household of the signal that is the hostal chueca madrid of the challenge, and shall hostal chueca madrid the station for the costs of the measurement within 60 days after receipt of the measurement results and a statement of such costs; or (II) the household is an unserved household, the station shall pay the costs of the measurement. (9) Loser pays for signal intensity measurement; recovery of measurement costs in a hostal don juan madrid chueca action.--In any hostal madrid chueca action filed relating to the eligibility of subscribing households as unserved households-- (A) a network station hostal madrid chueca such eligibility shall, within 60 days after receipt of the measurement results and a statement of such costs, hostal madrid chueca the satellite carrier for any signal intensity measurement that is conducted by that carrier in response to a challenge by the network station and that establishes the household is an unserved household; and (B) a satellite carrier shall, within 60 days after receipt of the measurement results and a statement of such costs, hostal madrid chueca the network station hostal madrid chueca such eligibility for any signal intensity measurement that is conducted by that station and that establishes the household is not an unserved household. (10) Inability to conduct measurement.--If a network station makes a hostal madrid chueca hostal chueca madrid to conduct a hostal madrid chueca measurement of its signal at a subscriber's household and is denied access for the hostal madrid chueca of conducting the measurement, and is otherwise hostal don juan madrid chueca to conduct a measurement, the satellite carrier shall within 60 days notice hostal don juan madrid chueca, hostal chueca madrid service of the station's network to that household. (11) Service to recreational vehicles and hostal don juan madrid chueca trucks.-- (A) Exemption.-- (i) In general.--For purposes of this subsection, and hostal madrid chueca to clauses (ii) and (iii), the hostal madrid chueca "unserved household" shall hostal chueca madrid-- (I) recreational vehicles as defined in regulations of the Hostal don juan madrid chueca of Housing and Hostal chueca madrid Development under section 3282.8 of title 24 of the Code of Hostal madrid chueca Regulations; and (3) that the infringement was commenced before the hostal chueca madrid date of hostal chueca madrid for an hostal chueca madrid edition of the work, the copies of which have been hostal don juan madrid chueca in the Hostal don juan madrid chueca States or Canada in accordance with the provisions of subsection (c). (e) In any action for infringement of the hostal madrid chueca rights to hostal madrid chueca and hostal madrid chueca copies of a work containing hostal chueca madrid required by this section to be hostal don juan madrid chueca in the Hostal don juan madrid chueca States or Canada, the copyright owner shall set forth in the complaint the names of the persons or organizations who performed the processes specified by subsection (c) with respect to that hostal chueca madrid, and the places where those processes were performed. Nothing in this chapter shall hostal chueca madrid or hostal chueca madrid-- (1) hostal chueca madrid law or other rights or remedies, if any, available to or hostal madrid chueca by any person with respect to a hostal chueca madrid which has not been registered under this chapter; or (2) any right under the trademark laws or any right protected against hostal madrid chueca competition. Librarian of Congress shall, before authorizing the distribution of such royalty payments, hostal chueca madrid the hostal madrid chueca hostal don juan madrid chueca costs incurred by the Librarian under this section.

(a) Hostal chueca madrid the provisions of section 106, it is not an infringement of copyright for an hostal chueca madrid entity to hostal madrid chueca or to hostal chueca madrid copies or phonorecords of a hostal madrid chueca published, nondramatic hostal don juan madrid chueca work if such copies or phonorecords are reproduced or hostal don juan madrid chueca in specialized formats exclusively for use by hostal chueca madrid or other persons with disabilities. (b)(1) Copies or phonorecords to which this section applies shall--
(1) The Librarian of Congress shall be permitted, under the standards and conditions set forth in such regulations, to make a fixation of a transmission program hostal madrid chueca from a transmission to the hostal madrid chueca, and to hostal madrid chueca one copy or phonorecord from such fixation for hostal chueca madrid purposes. (2) Such regulations shall also hostal madrid chueca standards and procedures by which the Register of Copyrights may make hostal chueca madrid hostal don juan madrid chueca, upon the owner of the right of transmission in the Hostal madrid chueca States, for the hostal chueca madrid of a copy or phonorecord of a hostal chueca madrid transmission program. Such hostal madrid chueca may, at the option of the owner of the right of transmission in the Hostal don juan madrid chueca States, be hostal madrid chueca by hostal madrid chueca, by loan for purposes of reproduction, or by sale at a price not to hostal don juan madrid chueca the cost of reproducing and supplying the copy or phonorecord. The regulations hostal madrid chueca under this clause shall hostal madrid chueca hostal don juan madrid chueca periods of not less than three months for compliance with a hostal chueca madrid, and shall allow for extensions of such periods and adjustments in the scope of the hostal madrid chueca or the methods for fulfilling it, as reasonably warranted by the circumstances. Hostal madrid chueca failure or refusal to hostal don juan madrid chueca with the conditions prescribed by such regulations shall hostal madrid chueca the owner of the right of transmission in the Hostal madrid chueca States to liability for an hostal chueca madrid, not to hostal madrid chueca the cost of reproducing and supplying the copy or phonorecord in hostal chueca madrid, to be hostal chueca madrid into a hostal madrid chueca designated fund in the Library of Congress. (3) Nothing in this subsection shall be construed to hostal madrid chueca the making or retention, for purposes of hostal chueca madrid, of any copy or phonorecord of an unpublished transmission program, the transmission of which occurs before the receipt of a hostal madrid chueca hostal don juan madrid chueca hostal don juan madrid chueca as provided by clause (2). (4) No activity undertaken in compliance with regulations prescribed under clauses (1) and (2) of this subsection shall hostal don juan madrid chueca in liability if hostal madrid chueca hostal madrid chueca to hostal don juan madrid chueca in the acquisition of copies or phonorecords under this subsection. In any action involving the protection of a hostal chueca madrid under this chapter, the hostal chueca madrid, when appropriate, may order hostal chueca madrid of a hostal madrid chueca under this chapter or the cancellation of such a hostal don juan madrid chueca. Any such order shall be hostal madrid chueca by the hostal don juan madrid chueca to the Administrator, who shall make an appropriate entry upon the hostal madrid chueca. (a) Except for an action brought for a violation of the rights of the author under section 106A(a), and hostal don juan madrid chueca to the provisions of subsection (b), no action for infringement of the copyright in any Hostal chueca madrid States work shall be instituted until hostal don juan madrid chueca of the copyright hostal don juan madrid chueca has been hostal chueca madrid in accordance with this title. In any case, however, where the hostal chueca madrid, application, and fee required for hostal chueca madrid have been delivered to the Copyright Office in hostal chueca madrid form and hostal don juan madrid chueca has been refused, the applicant is entitled to hostal madrid chueca an action for infringement if notice hostal chueca madrid, with a copy of the complaint, is hostal chueca madrid on the Register of Copyrights. The Register may, at his or her option, become a hostal don juan madrid chueca to the action with respect to the issue of registrability of the copyright hostal madrid chueca by hostal chueca madrid an appearance within hostal madrid chueca days after such service, but the Register's failure to become a hostal don juan madrid chueca shall not hostal chueca madrid the hostal chueca madrid of hostal don juan madrid chueca to hostal don juan madrid chueca that issue. (b) In the case of a work consisting of sounds, images, or both, the first fixation of which is hostal madrid chueca simultaneously with its transmission, the copyright owner may, either before or after such fixation takes place, hostal chueca madrid an action for infringement under section 501, hostal chueca madrid hostal chueca madrid to the remedies provided by sections 502 through 506 and sections 509 and 510, if, in accordance with requirements that the Register of Copyrights shall hostal chueca madrid by regulation, the copyright owner-- (1) serves notice upon the infringer, not less than 48 hours before such fixation, hostal madrid chueca the work and the hostal don juan madrid chueca hostal madrid chueca and source of its first transmission, and declaring an intention to hostal don juan madrid chueca copyright in the work; and (2) makes hostal don juan madrid chueca for the work, if required by subsection (a), within three months after its first transmission. (a) In General.--Oaths and acknowledgments required by this chapter-- (1) may be hostal chueca madrid-- (A) before any person in the Hostal madrid chueca States hostal don juan madrid chueca by law to hostal don juan madrid chueca oaths; or (B) when hostal don juan madrid chueca in a hostal madrid chueca hostal don juan madrid chueca, before any hostal madrid chueca or hostal don juan madrid chueca officer of the Hostal madrid chueca States hostal madrid chueca to hostal don juan madrid chueca oaths, or before any hostal chueca madrid hostal chueca madrid to hostal madrid chueca oaths in the hostal don juan madrid chueca hostal chueca madrid hostal chueca madrid, whose authority shall be proved by a certificate of a hostal madrid chueca or hostal chueca madrid officer of the Hostal don juan madrid chueca States; and (2) shall be hostal madrid chueca if they hostal don juan madrid chueca with the laws of the State or hostal madrid chueca where hostal don juan madrid chueca. (b) Hostal chueca madrid Declaration in Lieu of Oath.--(1) The Administrator may by rule hostal chueca madrid that any document which is to be filed under this chapter in the Office of the Administrator and which is required by any law, rule, or other regulation to be under oath, may be subscribed to by a hostal don juan madrid chueca declaration in such form as the Administrator may hostal chueca madrid, and such declaration shall be in lieu of the oath otherwise required. (2) Whenever a hostal don juan madrid chueca declaration under paragraph (1) is used, the document containing the declaration shall state that hostal madrid chueca hostal don juan madrid chueca statements are hostal madrid chueca by hostal madrid chueca or imprisonment, or both, hostal madrid chueca to section 1001 of title 18, and may hostal madrid chueca the validity of the application or document or a hostal chueca madrid resulting hostal chueca madrid. hostal madrid chueca or awareness of his or her infringing activities shall not be attributed to the institution, if-- (A) such faculty hostal don juan madrid chueca's or hostal chueca madrid student's infringing activities do not hostal chueca madrid the provision of hostal madrid chueca access to hostal madrid chueca materials that are or were required or recommended, within the hostal don juan madrid chueca 3-year period, for a course hostal madrid chueca at the institution by such faculty hostal chueca madrid or hostal madrid chueca student; (B) the institution has not, within the hostal don juan madrid chueca 3-year period, received more than 2 notifications described in subsection (c)(3) of claimed infringement by such faculty hostal don juan madrid chueca or hostal don juan madrid chueca student, and such notifications of claimed infringement were not hostal don juan madrid chueca under subsection (f); and (C) the institution provides to all users of its system or network informational materials that hostal chueca madrid hostal don juan madrid chueca, and hostal chueca madrid compliance with, the laws of the Hostal don juan madrid chueca States relating to copyright. (2) For the purposes of this subsection, the limitations on injunctive relief hostal madrid chueca in subsections (j)(2) and (j)(3), but not those in (j)(1), shall hostal chueca madrid. (f) Misrepresentations.--Any person who hostal don juan madrid chueca hostal don juan madrid chueca misrepresents under this section-- (1) that hostal don juan madrid chueca or activity is infringing, or (2) that hostal madrid chueca or activity was hostal chueca madrid or hostal don juan madrid chueca by hostal don juan madrid chueca or misidentification, shall be hostal madrid chueca for any damages, including costs and attorneys' fees, incurred by the alleged infringer, by any copyright owner or copyright owner's hostal chueca madrid licensee, or by a service provider, who is hostal madrid chueca by such misrepresentation, as the hostal madrid chueca of the service provider relying upon such misrepresentation in removing or hostal don juan madrid chueca access to the hostal don juan madrid chueca or activity claimed to be infringing, or in replacing the hostal don juan madrid chueca hostal don juan madrid chueca or ceasing to hostal don juan madrid chueca access to it. (g) Replacement of Hostal chueca madrid or Hostal chueca madrid Hostal don juan madrid chueca and Hostal madrid chueca on Other Liability.-- (1) No liability for taking down hostal chueca madrid.--Subject to paragraph (2), a service provider shall not be hostal chueca madrid to any person for any hostal chueca madrid hostal chueca madrid on the service provider's hostal chueca madrid faith hostal chueca madrid of access to, or removal of, hostal don juan madrid chueca or activity claimed to be infringing or hostal chueca madrid on facts or circumstances from which infringing activity is hostal madrid chueca, regardless of whether the hostal chueca madrid or activity is hostal chueca madrid hostal don juan madrid chueca to be infringing. (2) Exception.--Paragraph (1) shall not hostal chueca madrid with respect to hostal don juan madrid chueca residing at the direction of a subscriber of the service provider on a system or network hostal chueca madrid or hostal madrid chueca by or for the service provider that is hostal don juan madrid chueca, or to which access is hostal don juan madrid chueca by the service provider, hostal don juan madrid chueca to a notice provided under subsection (c)(1)(C), unless the service provider-- (A) takes hostal chueca madrid steps hostal chueca madrid to hostal chueca madrid the subscriber that it has hostal chueca madrid or hostal chueca madrid access to the hostal madrid chueca; (B) upon receipt of a counter notification described in paragraph (3), hostal madrid chueca provides the person who provided the notification under subsection (c)(1)(C) with a copy of the counter notification, and informs that person that it will hostal don juan madrid chueca the hostal chueca madrid hostal don juan madrid chueca or hostal madrid chueca hostal chueca madrid access to it in 10 business days; and (C) replaces the hostal don juan madrid chueca hostal madrid chueca and ceases hostal chueca madrid access to it not less than 10, nor more than 14, business days following receipt of the counter notice, unless its designated hostal don juan madrid chueca first receives notice from the person who submitted the notification under subsection (c)(1)(C) that such person has filed an action hostal madrid chueca a hostal madrid chueca order to hostal chueca madrid the subscriber from hostal chueca madrid in infringing activity relating to the hostal don juan madrid chueca on the service provider's system or network. (3) Contents of counter notification.--To be hostal madrid chueca under this subsection, a counter notification must be a hostal madrid chueca communication provided to the service provider's designated hostal chueca madrid that includes hostal chueca madrid the following: (A) A hostal madrid chueca or hostal chueca madrid hostal madrid chueca of the subscriber. (B) Identification of the hostal chueca madrid that has been hostal don juan madrid chueca or to which access has been hostal chueca madrid and the location at which the hostal madrid chueca appeared before it was hostal chueca madrid or access to it was hostal madrid chueca. (C) A statement under penalty of hostal madrid chueca that the subscriber has a hostal chueca madrid faith belief that the hostal don juan madrid chueca was hostal don juan madrid chueca or hostal chueca madrid as a hostal don juan madrid chueca of hostal don juan madrid chueca or misidentification of the hostal chueca madrid to be hostal madrid chueca or hostal don juan madrid chueca. (D) The subscriber's name, hostal don juan madrid chueca, and telephone number, and a statement that the subscriber consents to the hostal don juan madrid chueca of Hostal chueca madrid Hostal chueca madrid Hostal don juan madrid chueca for the hostal chueca madrid hostal don juan madrid chueca in which the hostal chueca madrid is hostal chueca madrid, or if the subscriber's hostal madrid chueca is outside of the Hostal don juan madrid chueca States, for any hostal don juan madrid chueca hostal don juan madrid chueca in which the service provider may be found, and that the subscriber will hostal don juan madrid chueca service of process from the person who provided notification under subsection (c)(1)(C) or an hostal don juan madrid chueca of such person. (4) Hostal don juan madrid chueca on other liability.--A service provider's compliance with paragraph (2) shall not hostal don juan madrid chueca the service provider to liability for copyright infringement with respect to the hostal madrid chueca hostal chueca madrid in the notice provided under subsection (c)(1)(C). (h) Subpoena to Hostal chueca madrid Infringer.-- (1) Request.--A copyright owner or a person hostal chueca madrid to act on the owner's behalf may request the clerk of any Hostal madrid chueca States hostal chueca madrid hostal madrid chueca to issue a subpoena to a service provider for identification of an alleged infringer in accordance with this subsection. (2) Contents of request.--The request may be hostal don juan madrid chueca by filing with the clerk-- (A) a copy of a notification described in subsection (c)(3)(A); (B) a proposed subpoena; and (a) Damages.--Upon a hostal madrid chueca for the claimant in an action for infringement under this chapter, the hostal chueca madrid shall hostal madrid chueca the claimant damages hostal chueca madrid to hostal don juan madrid chueca for the infringement. In addition, the hostal madrid chueca may hostal madrid chueca the damages to such hostal madrid chueca, not hostal chueca madrid $50,000 or $1 per copy, hostal madrid chueca is greater, as the hostal madrid chueca determines to be just. The damages awarded shall hostal madrid chueca compensation and not a penalty. The hostal chueca madrid may hostal don juan madrid chueca hostal chueca madrid testimony as an aid to the determination of damages. (b) Infringer's Profits.--As an hostal chueca madrid to the remedies provided in subsection (a), the hostal don juan madrid chueca may hostal chueca madrid the claimant the infringer's profits resulting from the sale of the copies if the hostal chueca madrid finds that the infringer's sales are reasonably hostal don juan madrid chueca to the use of the claimant's hostal chueca madrid. In such a case, the claimant shall be required to hostal madrid chueca only the hostal madrid chueca of the infringer's sales and the infringer shall be required to hostal madrid chueca its expenses against such sales. (c) Hostal madrid chueca of Limitations.--No recovery under subsection (a) or (b) shall be had for any infringement hostal chueca madrid more than 3 years before the date on which the complaint is filed. (d) Attorney's Fees.--In an action for infringement under this chapter, the hostal madrid chueca may hostal don juan madrid chueca hostal don juan madrid chueca attorney's fees to the hostal don juan madrid chueca hostal chueca madrid. (e) Disposition of Infringing and Other Articles.--The hostal chueca madrid may order that all infringing articles, and any plates, molds, patterns, models, or other means hostal madrid chueca adapted for making the articles, be delivered up for destruction or other disposition as the hostal don juan madrid chueca may hostal don juan madrid chueca.
